California courts require more than a parent’s preference to reopen a custody order. The court needs a showing of significant changed circumstances since the original order was entered, and the analysis centers on the best interests of the child, not the wishes of either parent in isolation.

Circumstances that commonly support a modification request include a parent’s relocation, a substantial shift in a parent’s work schedule, a change in the child’s school or health needs, domestic violence, or a parent’s substance abuse issues. Modifications can be contested and resolved through a court hearing, or agreed upon through a stipulated order submitted for judicial approval. A verbal agreement between parents carries no legal weight and isn’t enforceable if one party later walks it back.

Child Support Modifications in California

California calculates child support under a statewide guideline formula that weighs each parent’s net disposable income and the percentage of time each parent has primary physical responsibility for the child. Because support is tied to those variables, a substantial change in either can justify revisiting the order.

Common triggers for a child support modification include:

• A significant income change for either parent, including job loss or a pay increase
• A shift in the parenting timeshare arrangement
• A material change in the child’s expenses

Either parent may request an increase or a decrease. Before committing to a formal filing, a party can request the other parent’s current income information without first filing a modification motion, which allows an early assessment of whether a guideline change is likely. If the case proceeds, both parents must submit a current Income and Expense Declaration.

Spousal Support Modifications & Termination

Unless a spousal support order was expressly made non-modifiable in the divorce judgment, either party may ask the court to increase, decrease, or terminate support upon a substantial change of circumstances. The court evaluates current and past circumstances against the factors in California Family Code Section 4320 to determine whether a modification is warranted.

Triggering circumstances often include the paying spouse’s job loss or income reduction, the receiving spouse’s new employment or higher earnings, or the passage of significant time combined with the receiving spouse’s capacity to become self-supporting. The passage of time alone isn’t enough. Parties can also negotiate an agreed modification and submit it as a stipulated order, or resolve ongoing support with a lump-sum settlement. Unwritten or verbal arrangements aren’t enforceable and can result in arrears plus interest if the original order is later enforced.

Filing a Modification with the Sacramento Superior Court

Post-judgment modification proceedings in Sacramento County are handled by the Family Law Division of the Sacramento Superior Court, housed at the William R. Ridgeway Family Relations Courthouse. Documents may be filed in person, by mail, or through a fax filing agency.

A modification typically begins with a Request for Order (RFO), the formal document that sets the matter for a hearing.
