What Is Family Law Mediation & How Does It Work?
Under California Evidence Code section 1115(a), mediation is a process in which a neutral person or persons facilitate communication between disputants to help them reach a mutually acceptable agreement. In plain terms, the mediator doesn’t make decisions for you. Their role is to guide communication, surface each party’s underlying interests and priorities, and help you work toward solutions that fit your family’s actual circumstances. The Mediation Process, Step by Step
The process typically begins with an initial meeting where everyone establishes ground rules for communication. From there, sessions address the substantive issues: property division, a parenting plan for your children, and spousal and child support. Full financial disclosure is a required step. It creates the transparency productive negotiations depend on.
If the parties reach agreement on all issues, the mediator or an attorney drafts a formal marital settlement agreement, a legally binding contract reflecting the decided terms. After both parties review and sign, the agreement is submitted to court for consideration as a final, enforceable order. Either party may also work with a consulting attorney (sometimes called independent legal counsel) who advises them alongside the mediation process without participating directly in sessions. A party may withdraw from mediation at any time if the process isn’t working.

Most divorce issues are handled through voluntary mediation. In Sacramento County, however, mediation through Family Court Services is required when child custody or visitation is contested, and that process is typically limited to a single session focused on those issues alone.
